A lawsuit has been filed accusing overHere, its founder Clinton So, social media influencer Alex Larson Schultz and the Tuah The Moon Foundation (which is understood to have overseen the finances of the meme coin) of unlawfully promoting and selling cryptocurrency that was allegedly never properly registered.
Fans and investors have accused Ms Welch and her team of “misleading” and “betraying” them and suggested the launch had been a “rug pull” – where promoters of a cryptocurrency draw in buyers, only to stop trading activity and make off with money raised from sales.

Haliey Welch, popularly known as the “Hawk Tuah” girl, has officially been cleared of any wrongdoing after the U.S. Securities and Exchange Commission (SEC) closed its investigation into her controversial meme coin, $HAWK.

The day after the coin’s turbulent launch, So made the Tuah Foundation an off-shore entity and sold 17% of the tokens through the foundation to a group of people to escape securities laws, according to the complaint.
Burwick PLLC, which teamed up with law firm Wolf Popper LLC, said that $HAWK’s token market capitalization “surged” to $491 million after launching on Dec. 4, but its “meteoric rise was short-lived, as the $HAWK token’s value plummeted by over 90% within hours, dropping below $100 million.”
Despite the coin bearing her “Hawk Tuah” brand, there has been radio silence on the controversy from Welch. She has not posted on her social media or uploaded a new podcast episode since the coin crashed.
The cryptocurrency lost more than 95 percent of its value in a single day when it was released on Dec. 4, seeing its value plunge by $440 million in just 20 minutes. Responding to the lawsuit, Welch wrote on X, formerly Twitter: “I take this situation extremely seriously and want to address my fans, the investors who have been affected, and the broader community.
